Terms of Service

Acceptance
These Terms of Service are an agreement between you and Tailboard Academy ("we," "us"). By creating an account or using the app, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the service. Tailboard Academy offers both free features and paid subscriptions. The price, billing interval, free-trial terms, and cancellation and refund rules for paid plans are shown at checkout and described in our Refund Policy, which forms part of these terms. Some users receive full access through a school or program enrollment or a comped code; that access lasts only as long as the program or code provides.
Eligibility
You must be at least 16 years old — or the age of majority where your local law requires it — to use Tailboard Academy. The service is intended for adults preparing for careers in the fire service and EMS. By creating an account, you confirm you meet this requirement and that the information you provide is accurate.
Educational use only
Tailboard Academy is a study and hiring-preparation tool. Everything in it — practice exams, the AI oral-board coach, scenario simulations, the "Ask the Firefighter" mentor chat, the veteran experience translator, study lessons, flashcards, the EKG tool, med-math and radio-report trainers, the hiring-pipeline tracker, and fitness plans — is for education and practice only.
Nothing in the app is medical, clinical, or legal advice. It is not a substitute for accredited training, medical direction, or your department's or agency's protocols. Always verify clinical content against current guidelines and your local protocols before applying it to real patients. Real-world patient care must follow your certification level, your medical director, and your local protocol — not a study app. Fitness plans are general educational content, not a personalized medical or training prescription; consult a qualified professional before starting a new fitness program.
No professional relationship or guarantee
Using Tailboard Academy does not create any professional, advisory, employment, or agency relationship between you and us. We make no promises about outcomes: we do not guarantee that you will pass any exam or certification, or that you will be hired by any department or agency. Practice scores in the app are study feedback, not predictions of real exam results. Your preparation, testing, and hiring outcomes depend on you and on the agencies involved.
No affiliation or endorsement
Tailboard Academy is an independent study tool. We are not affiliated with, endorsed by, or sponsored by any fire department or hiring agency, the National Registry of Emergency Medical Technicians (NREMT), the American Heart Association, the U.S. Department of Veterans Affairs (VA), or the U.S. Department of Defense (DoD). When names like these appear in the app, they are used only to accurately describe what our content helps you prepare for (nominative use). All trademarks belong to their respective owners.
AI-generated content disclaimer
Parts of the app are powered by AI (Anthropic's Claude models), including practice questions, coaching feedback, scoring, and chat responses. AI-generated content may be inaccurate, incomplete, or outdated, and it can sound confident while being wrong. It is provided for practice and education only. Do not rely on it for real patient care, exam answers, or legal or employment decisions, and verify anything important against authoritative sources. See our Privacy Policy for how your inputs to AI features are handled.
Acceptable use
Use the app for your own study and preparation. You agree not to:
- Submit real patient information (PHI) or other people's personal data into the app, including AI features
- Scrape, bulk-download, or systematically copy app content or question banks
- Abuse the AI endpoints — for example, automated or excessive requests, or attempts to bypass rate limits or usage safeguards
- Attempt to reverse engineer, decompile, or probe the app or its infrastructure
- Share your account, misrepresent your identity, or use the service for anything unlawful
- Interfere with the service or other users' use of it
We may suspend or terminate accounts that violate these rules.
Accounts & security
You need an account (name, email, and password) to use the app. Keep your password confidential — you are responsible for activity that happens under your account. Tell us at support@tailboardacademy.com promptly if you suspect unauthorized access. We may suspend accounts to protect the service or other users.
User-submitted content
Content you enter into the app — your practice answers, hiring-pipeline entries, notes, and testimonial ("win") text — belongs to you. By submitting it, you give us the limited license needed to store, process, and display it back to you so the app works.
If you submit a testimonial, you grant us a non-exclusive, royalty-free license to display it in the app and in our marketing only if it is approved for that use. You can ask us to take a displayed testimonial down at any time by emailing support@tailboardacademy.com. You're responsible for what you submit — don't submit content you don't have the right to share.
Intellectual property
The app itself — its lessons, practice questions, simulations, trainers, design, and code — is owned by Tailboard Academy or its licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable license to use the app and its content for your own study and hiring preparation. You may not resell, republish, redistribute, or use the content to build a competing product or question bank.
Disclaimers of warranty
The service is provided "as is" and "as available," without warranties of any kind, express or implied — including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that content (including AI-generated content) is accurate or complete. Some jurisdictions don't allow certain warranty exclusions, so parts of this section may not apply to you.
Limitation of liability
To the maximum extent permitted by law, Tailboard Academy and its owners will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost opportunities (including exam or hiring outcomes), arising from your use of — or inability to use — the service. To the extent any liability is not excluded, our total liability for all claims related to the service is limited to the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars (US $100). Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold harmless Tailboard Academy and its owners from claims, damages, and reasonable expenses (including attorneys' fees) arising from your violation of these terms, your misuse of the service, or content you submit — including any claim that content you submitted infringes someone else's rights or contained personal or patient data you weren't permitted to share.
Termination
You can stop using the service or delete your account at any time from account settings; deletion removes your account and associated data as described in the Privacy Policy. We may suspend or terminate your access if you violate these terms, if required by law, or if we discontinue the service. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and indemnification) survive.
Changes to terms
We may update these terms from time to time. If we do, we'll update the effective date at the top and, for material changes, notify you in the app or by email before they take effect. Continuing to use the service after changes take effect means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules, and disputes will be resolved in courts located in California. (Attorney: confirm governing law, venue, and whether an arbitration or small-claims provision is appropriate.)
